Via Politico: ‘Twenty climate scientists called for RICO investigation in a letter to Obama and U.S. Attorney General Loretta Lynch. The scientists argue that the systemic efforts to prevent the public from understanding climate change resembles the investigation undertaken against tobacco. They draw inspiration from Sen. Sheldon Whitehouse who said on the Senate floor that there might be a similar conspiracy here, and a civil trial could provide the tools of discovery needed to find out.’

Dear President Obama,Attorney General Lynch and OSTP Director Holdren,

As you know, an overwhelming majority of climate scientists are convinced about the potentially serious adverse effects of human-induced climate change on human health, agriculture,and biodiversity.

We applaud your efforts to regulate emissions and the other steps you are taking.

Nonetheless, as climate scientists we are exceedingly concerned that America’s response to climate change–indeed, the world’s response to climate change–is insufficient. The risks posed by climate change, including increasing extreme weather events, rising sea levels, and increasing ocean acidity–and potential strategies for addressing them–are detailed in the Third National Climate Assessment (2014),

Climate Change Impacts in the United States. The stability of the Earth’s climate over the past ten thousand years contributed to the growth of agriculture and therefore, a thriving human civilization. We are now at high risk of seriously destabilizing the Earth’s climate and irreparably harming people around the world, especially the world’s poorest people.We appreciate that you are making aggressive and imaginative use of the limited tools available to you in the face of a recalcitrant Congress.

One additional tool–recently proposed by Senator Sheldon Whitehouse (D-RI)–is a RICO (Racketeer Influenced and Corrupt Organizations Act) investigation of corporations and other organizations that have knowingly deceived the American people about the risks of climate change, as a means to forestall America’s response to climate change.

The actions of these organizations have been extensively documented in peer-reviewed academic research (Brulle,2013) and in recent books including: Doubt is their Product (Michaels, 2008), Climate Cover Up (Hoggan & Littlemore, 2009), Merchants of Doubt (Oreskes & Conway, 2010),The Climate War (Pooley, 2010), and in The Climate Deception Dossiers (Union of Concerned Scientists, 2015).

We strongly endorse Senator Whitehouse’s call for a RICO investigation. The methods of these organizations are quite similar to those used earlier by the tobacco industry.

A RICO investigation (1999 to 2006) played an important role in stopping the tobacco industry from continuing to deceive the American people about the dangers of smoking.

If corporations in the fossil fuel industry and their supporters are guilty of the misdeeds that have been documented in books and journal articles, it is imperative that these misdeeds be stopped as soon as possible so that America and the world can get on with the critically important business of finding effective ways to restabilize the Earth’s climate, before even more lasting damage is done.

Our “The Sky is Falling!!! We’re all going to Die!!!!” unless you do exactly as we say hasn’t been working so now it’s time for the Hammer of Social Justice and The US Government to beat the infidels into submission.

The “good” Senator from Rhode Island in an Op-Ed in the Washington Post:

Fossil fuel companies and their allies are funding a massive and sophisticated campaign to mislead the American people about the environmental harm caused by carbon pollution.

Where’s the science? Oh right, it’s just evil Corporate Oil doing their mustache twirling evil deception. Unlike the disingenuous Chicken Little’s in the Global Cooling/Warming/Change holy mission of salvation. 🙂

Their activities are often compared to those of Big Tobacco denying the health dangers of smoking. Big Tobacco’s denial scheme was ultimately found by a federal judge to have amounted to a racketeering enterprise.

You mean the ones you probably supported and still take their money?

Well, Liberals are like Orwellian Nazis as they have “often been compared”. 🙂

The Big Tobacco playbook looked something like this: (1) pay scientists to produce studies defending your product; (2) develop an intricate web of PR experts and front groups to spread doubt about the real science; (3) relentlessly attack your opponents.

The Global Warming playbook goes something like this: (1) pay scientists to produce studies defending your product; (Climate Gate, anyone?) (2) develop an intricate web of PR experts and front groups to spread doubt about the real science; “97% Consensus” anyone? (3) relentlessly attack your opponents. Attack “Deniers” with RICO statutes and EPA regulations anyone?

Thankfully, the government had a playbook, too: the Racketeer Influenced and Corrupt Organizations Act, or RICO. In 1999, the Justice Department filed a civil RICO lawsuit against the major tobacco companies and their associated industry groups, alleging that the companies “engaged in and executed — and continue to engage in and execute — a massive 50-year scheme to defraud the public, including consumers of cigarettes, in violation of RICO.”

Is the Tobacco Industry still around? Yep. They just are 1/10 the Lobbying juggernaut they used to be.

Do people still smoke? Yep.

Tobacco spent millions of dollars and years of litigation fighting the government. But finally, through the discovery process, government lawyers were able to peel back the layers of deceit and denial and see what the tobacco companies really knew all along about cigarettes.

You mean the million in lobbying money. And amazing how they can uncover all this and not be able to figure out Benghazi, or the IRS scandal, or Hillary’s Emails? 🙂

In 2006, Judge Gladys Kessler of the U.S. District Court for the District of Columbia decided that the tobacco companies’ fraudulent campaign amounted to a racketeering enterprise. According to the court: “Defendants coordinated significant aspects of their public relations, scientific, legal, and marketing activity in furtherance of a shared objective — to . . . maximize industry profits by preserving and expanding the market for cigarettes through a scheme to deceive the public.”

The parallels between what the tobacco industry did and what the fossil fuel industry is doing now are striking.

Only in your fervently anti-capitalist Luddite little mind.

In the case of fossil fuels, just as with tobacco, the industry joined together in a common enterprise and coordinated strategy.

Just like the Sky is Falling Global Warming “Consensus” crowd.

He has his own Political Action group: Oceans PAC and he gets his primary support from tech company investors & lobbyists from Comcast.

I created the OCEANS PAC because candidates who support oceans and environmental issues need our support. Indeed, the other side is funded by big polluters who don’t hesitate to put millions of dollars behind their lies. As I’ve said many times – I’m tired of bringing a knife to a gun fight. The OCEANS PAC is one way we can fight back.

And fight we must, because climate change is not a problem that will go away. Climate change is not a problem that can wait. But climate change is a problem that can be solved.  We can and we must leave a healthy environment, which includes healthy oceans, to our children and grandchildren. The public is ready for action; unfortunately, the missing piece is Congress. Congress is sleepwalking through history. It is time for Congress to hear the alarms, roll up our sleeves, and do what needs to be done. It is time to wake up. But for Congress to wake up, it needs more members who will support ocean and environmental issues – OCEANS PAC will support those candidates.

In 1998, the Clinton administration was building support for international climate action under the Kyoto Protocol. The fossil fuel industry, its trade associations and the conservative policy institutes that often do the industry’s dirty work met at the Washington office of the American Petroleum Institute. A memo from that meeting that was leaked to the New York Times documented their plans for a multimillion-dollar public relations campaign to undermine climate science and to raise “questions among those (e.g. Congress) who chart the future U.S. course on global climate change.”

Climate Gate anyone?

The shape of the fossil fuel industry’s denial operation has been documented by, among others, Drexel University professor Robert Brulle. In a 2013 paper published in the journal Climatic Change, Brulle described a complex network of organizations and funding that appears designed to obscure the fossil fuel industry’s fingerprints. To quote directly from Brulle’s report, it was “a deliberate and organized effort to misdirect the public discussion and distort the public’s understanding of climate.” That sounds a lot like Kessler’s findings in the tobacco racketeering case.

The coordinated tactics of the climate denial network, Brulle’s report states, “span a wide range of activities, including political lobbying, contributions to political candidates, and a large number of communication and media efforts that aim at undermining climate science.” Compare that again to the findings in the tobacco case.

Funny, sounds just like the Global Warming crowd!

The tobacco industry was proved to have conducted research that showed the direct opposite of what the industry stated publicly — namely, that tobacco use had serious health effects. Civil discovery would reveal whether and to what extent the fossil fuel industry has crossed this same line. We do know that it has funded research that — to its benefit — directly contradicts the vast majority of peer-reviewed climate science. One scientist who consistently published papers downplaying the role of carbon emissions in climate change, Willie Soon, reportedly received more than half of his funding from oil and electric utility interests: more than $1.2 million.

To be clear: I don’t know whether the fossil fuel industry and its allies engaged in the same kind of racketeering activity as the tobacco industry. We don’t have enough information to make that conclusion. Perhaps it’s all smoke and no fire. But there’s an awful lot of smoke.

And he knows smoke when he sees it…

Senator Whitehouse stated (On the Iran Deal): “I thank the many Rhode Islanders who have contacted me on every side of this question. I appreciate their thoughtful input.  I’ve decided to support the P5+1 agreement with Iran, not because it assures anything on its own, but because — with persistent watchfulness and effort — it could open a new doorway in the precarious Middle East. I do not see a better credible option.

And since he knows a good deal when he sees it, he must be right about Global Warming! 🙂

Last Time the US Senate passed a Budget: 1,413 days ago

The iPad wasn”t even on the Market back then!

The budget deficit for fiscal year 2009 was $1.4 trillion, followed by $1.3 trillion deficits in 2010 and 2011.  In fiscal year 2012 the deficit again surpassed the $1 trillion mark, the Treasury announced in October. And 2013 is expected to be just as bad.

But ask a Liberal about this and the raving pit bull slobbering with hate with try and bite your face off. It’s all those “Obstructionist” Republicans fault. They won’t pass a Budget that the Democrats like so they ignore it, pretend it never existed, and blame them for the whole problem to begin with.

If only they would just do what the Republicans want. If only every American would just do what they want, when they want them them to, because they want them too.

Simple enough, right?  Just do as you’re told when you’re told. That’s it.

Utopia, peace, and BY-Partisanship awaits you if you just do as your told without question. 🙂

If you want a sense of just how massive the nation’s debt problem is, consider this: The U.S. added $226 billion in new debt in just the 35 days since President Obama missed the legal deadline to submit his budget.

That’s more than the government will spend this year on education, homeland security, law enforcement, housing aid, energy and the environment, combined.

Do that 5 times and you have an amount equal to the OMG! The Sky is Falling decrease in the increase called the Sequester.

A 1921 law requires the president to submit his budget plan to Congress on the first Monday in February, but Obama so far hasn’t produced one, and the White House says it won’t release its plan to get the nation’s deficits and debt under control until sometime in April.

Senate Democrats, meanwhile, haven’t produced an annual budget — also required by law — since 2009. Over that time, the nation’s debt has climbed $5.5 trillion, according to the Treasury Department.

But as we know, that’s all Bush’s Fault. Democrats are completely free of any responsibility for even one dime of this. 🙂

And they can’t fix it because of “Obstructionist” Republicans. 🙂

Senate Budget Committee Democrats are now promising to introduce a budget plan this week.

Obama initially claimed the holdup on his fiscal year 2014 budget was the last-minute “fiscal cliff” deal, which required them to redo their budget figures.

That agreement let the Bush tax cuts expire for people with incomes over $400,000, while making the rest of the lower Bush tax rates permanent. It also extended unemployment insurance, put off the automatic sequester spending cuts by two months, and let the Social Security payroll tax break expire.

“Because these issues were not resolved until the American Taxpayer Relief Act was enacted on Jan. 2, 2013, the administration was forced to delay some of its FY 2014 budget preparations, which in turn will delay the budget’s submission to Congress,” Jeffrey Zients, a director at the White House Office of Management and Budget, wrote to House Budget Committee Chairman Paul Ryan in mid-January.

But the fiscal cliff deal delayed by just one day the Congressional Budget Office’s annual report, which also had to account for all those fiscal cliff changes. The CBO budget and economic outlook report came out on Feb. 5.

The budget holdup comes as Obama and Democrats try to figure out how to deal with the nation’s debt crisis while protecting their favored spending programs and claiming only to want to raise taxes on the “rich.”

As the Hill reported this week, “disputes over tax cuts, spending reductions and entitlement reform all present challenges to Budget Committee chairwoman Patty Murray and Majority Leader Harry Reid.”

Meanwhile, Obama has been talking up a grand bargain again with Republicans, trading entitlement reforms for more tax hikes, before releasing his own detailed plan on how he would do it.

During the 2012 campaign, Obama told voters that all America needed to get its deficits under control was to ask the rich to pay “a little more so we can pay down our debt in a balanced way.”

After he won re-election, he talked as though the debt crisis was nearly solved. At a press conference early this year, he said the only thing left to do was “closing some additional loopholes (and) doing some additional cuts.”

But the latest CBO report makes it clear that the debt crisis is far from over, despite an intervening $620 billion tax hike on the wealthy that Obama secured as part of the fiscal cliff deal.

The CBO projects that under current law, deficits will fall for the next two years, then start climbing again. By 2023, red ink will be near $1 trillion again.

And debt as a share of the economy will start climbing as well, starting in 2018. The CBO predicts that just publicly traded federal debt will reach 77% of the economy in a decade’s time. Debt averaged just 41% of GDP from 1948 to 2008.

Entitlements Key

Obama has also said he will consider only modest changes to Medicare and Medicaid, and wants hands off Social Security. Leading congressional Democrats have vowed to fight any significant changes to entitlements.

But the CBO also makes clear that these programs must be ad dressed: “Unless the laws governing those programs are changed,” it noted, “debt will rise sharply relative to GDP after 2023.”

With Ryan promising a plan that not only cuts the deficit without more tax hikes but also produces a balanced budget in a decade, the debate over spending, taxes and the national debt is about to get very interesting.

Global Warming Update 2011

The Arctic ocean is warming up, icebergs are growing scarcer and in some places the seals are finding the water too hot, according to a report to the Commerce Department yesterday from Consulafft, at Bergen , Norway .  Reports from fishermen, seal hunters and explorers all point to a radical change in climate conditions and hitherto unheard-of temperatures in the Arctic zone.  Exploration expeditions report that scarcely any ice has been met as far north as 81 degrees 29 minutes.

Soundings to a depth of 3,100 meters showed the gulf stream still very warm.  Great masses of ice have been replaced by moraines of earth and stones, the report continued, while at many points well known glaciers have entirely disappeared.

Very few seals and no white fish are found in the eastern Arctic, while vast shoals of herring and smelts which have never before ventured so far north, are being encountered in the old seal fishing grounds.

Within a few years it is predicted that due to the ice melt the sea will rise and make most coastal cities uninhabitable………….

Oh God! We have to do something now or we’re all doomed!

There are ominous signs that the Earth’s weather patterns have begun to change dramatically and that these changes may portend a drastic decline in food production – with serious political implications for just about every nation on Earth. The drop in food output could begin quite soon, perhaps only 10 years from now. The regions destined to feel its impact are the great wheat-producing lands of Canada and the U.S.S.R. in the North, along with a number of marginally self-sufficient tropical areas – parts of India, Pakistan, Bangladesh, Indochina and Indonesia – where the growing season is dependent upon the rains brought by the monsoon.

The evidence in support of these predictions has now begun to accumulate so massively that meteorologists are hard-pressed to keep up with it. In England, farmers have seen their growing season decline by about two weeks since 1950, with a resultant overall loss in grain production estimated at up to 100,000 tons annually. During the same time, the average temperature around the equator has risen by a fraction of a degree – a fraction that in some areas can mean drought and desolation. Last April, in the most devastating outbreak of tornadoes ever recorded, 148 twisters killed more than 300 people and caused half a billion dollars’ worth of damage in 13 U.S. states.

To scientists, these seemingly disparate incidents represent the advance signs of fundamental changes in the world’s weather. The central fact is that after three quarters of a century of extraordinarily mild conditions, the earth’s climate seems to be cooling down. 🙂 Meteorologists disagree about the cause and extent of the cooling trend, as well as over its specific impact on local weather conditions. But they are almost unanimous in the view that the trend will reduce agricultural productivity for the rest of the century. If the climatic change is as profound as some of the pessimists fear, the resulting famines could be catastrophic. “A major climatic change would force economic and social adjustments on a worldwide scale,” warns a recent report by the National Academy of Sciences, “because the global patterns of food production and population that have evolved are implicitly dependent on the climate of the present century.”

A survey completed last year by Dr. Murray Mitchell of the National Oceanic and Atmospheric Administration reveals a drop of half a degree in average ground temperatures in the Northern Hemisphere between 1945 and 1968. According to George Kukla of Columbia University, satellite photos indicated a sudden, large increase in Northern Hemisphere snow cover in the winter of 1971-72. And a study released last month by two NOAA scientists notes that the amount of sunshine reaching the ground in the continental U.S. diminished by 1.3% between 1964 and 1972.

To the layman, the relatively small changes in temperature and sunshine can be highly misleading. Reid Bryson of the University of Wisconsin points out that the Earth’s average temperature during the great Ice Ages was only about seven degrees lower than during its warmest eras – and that the present decline has taken the planet about a sixth of the way toward the Ice Age average. Others regard the cooling as a reversion to the “little ice age” conditions that brought bitter winters to much of Europe and northern America between 1600 and 1900 – years when the Thames used to freeze so solidly that Londoners roasted oxen on the ice and when iceboats sailed the Hudson River almost as far south as New York City.

Just what causes the onset of major and minor ice ages remains a mystery. “Our knowledge of the mechanisms of climatic change is at least as fragmentary as our data,” concedes the National Academy of Sciences report.

But just like now they jumped to hysterical conclusions. Only now, they also falsify data, suppress data and openly admit to lying through there collectivist teeth. But we’re still supposed to take their doom and gloom seriously.

“Not only are the basic scientific questions largely unanswered, but in many cases we do not yet know enough to pose the key questions.”

Meteorologists think that they can forecast the short-term results of the return to the norm of the last century. They begin by noting the slight drop in overall temperature that produces large numbers of pressure centers in the upper atmosphere. These break up the smooth flow of westerly winds over temperate areas. The stagnant air produced in this way causes an increase in extremes of local weather such as droughts, floods, extended dry spells, long freezes, delayed monsoons and even local temperature increases – all of which have a direct impact on food supplies.

“The world’s food-producing system,” warns Dr. James D. McQuigg of NOAA’s Center for Climatic and Environmental Assessment, “is much more sensitive to the weather variable than it was even five years ago.” Furthermore, the growth of world population and creation of new national boundaries make it impossible for starving peoples to migrate from their devastated fields, as they did during past famines.

Climatologists are pessimistic that political leaders will take any positive action to compensate for the climatic change, or even to allay its effects. They concede that some of the more spectacular solutions proposed, such as melting the Arctic ice cap by covering it with black soot or diverting arctic rivers, might create problems far greater than those they solve. But the scientists see few signs that government leaders anywhere are even prepared to take the simple measures of stockpiling food or of introducing the variables of climatic uncertainty into economic projections of future food supplies. The longer the planners delay, the more difficult will they find it to cope with climatic change once the results become grim reality.

So they’ve been at this “sky is falling” schtick for  at 90 years. Just like “universal” health care. Gee, I wonder… 🙂

Sheila Jackson Lee (D-TX): Arguing that the Commerce Clause provides the constitutional basis for ObamaCare, Jackson Lee said repealing the law by passing Republicans’ H.R. 2 violates both the Fifth Amendment’s right to due process and the Fourteenth Amendment’s equal protection clause.

“The Fifth Amendment speaks specifically to denying someone their life and liberty without due process,” she said in a speech on the House floor moments ago. “That is what H.R. 2 does and I rise in opposition to it. And I rise in opposition because it is important that we preserve lives and we recognize that 40 million-plus are uninsured.”

“Can you tell me what’s more unconstitutional than taking away from the people of America their Fifth Amendment rights, their Fourteenth Amendment rights, and the right to equal protection under the law?”

House Majority Whip James E. Clyburn called health-care reform “the Civil Rights Act of the 21st century”

So it’s a Civil Right now!! And we all know what taking away civil rights means?

Also in the interview Cohen stood by equally uncivil remarks he made last April when he compared the Tea Party to the KKK. (“The tea party people are kind of without robes and hoods. They have really shown a very hardcore angry side of America that is against any type of diversity. We saw opposition to African-Americans, hostility towards gays, hostility towards anyone who, you know, just wasn’t a clone of George Wallace’s fan club.”) He said the two movements arose from similar circumstances because both wanted “their power back.”

Rep. Cohen on Anderson Cooper 360 (CNN): “There were people who were out of power and they wanted their power back. The Klan after the Civil War was upset that the African Americans had been given the right to vote and many of them were in office and they didn’t like it. And they wanted to form to get back their own government. They wanted to take back their government. And the Tea Party feels like they are out of power with President Obama, that’s where they started, and they want to take back their government. Now without robes and hoods they’re not out doing things like the Klan did, but they got formed the same kind of way. They were people who had been disposed from being the power group and wanted to take it back.”

The Democrats from 1996 to 2008 when they were “out of power” are exempted of course!! 🙂

Cooper rebutted, “You can compare them to any populist movement, comparing them to the KKK seems incendiary. It seems deeply offense to hundreds of thousands of people who are in the Tea Party”

Like Rep. Cohen cares! He wants to repeat his lies often enough so you’ll believe them!

And don’t tell him that the Republican Party was born as an anti-slavery party and that the KKK was mostly Southern DEMOCRATS.

Oh no! Facts are holy water to Liberal vampires who just want to perpetuate their uncivil hatred of those who oppose their greatness.

“I won’t say it again, but I was right,” he said. -Rep Cohen

You just can’t make this stuff up.

Rep.  John Lewis (D-GA): “Well, when you start off with the Preamble of the Constitution, you talk about the pursuit of happiness,” said Lewis. “You go to the 14th Amendment–it’s equal protection under the law and we have not repealed the 14th Amendment. People have a right to have health care. It’s not a privilege but a right.”

The Preamble of the Constitution states, “We the People of the United States, in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the United States of America.”

IT IS NOT IN THE CONSTITUTION YOU LOON! (anyone seeing the 14th Amendment talking point yet, BTW?)

“We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.”

It is the preamble to THE DECLARATION OF INDEPENDENCE!

But I’m sure we have “misquoted” him. 🙂

Then he trotted out the thouroughly ridiculous “well you are required to have auto insurance” canard too!

That was thoroughly discredited by me over a year ago in 1 sentence!

If you don’t have a car, you don’t need or are required by law to have auto insurance!
