ObamaCare Update:

The U.S. Appeals Court for the 11th Circuit, based in Atlanta, ruled 2 to 1 that Congress exceeded its authority by requiring Americans to buy coverage…A divided three-judge panel of the 11th Circuit found that it did not pass muster under that clause or under the power of Congress to tax. The administration has said the penalty for not buying healthcare coverage is akin to a tax.

“This economic mandate represents a wholly novel and potentially unbounded assertion of congressional authority: the ability to compel Americans to purchase an expensive health insurance product they have elected not to buy, and to make them repurchase that insurance product every month for their entire lives,” the majority said in its 207-page opinion.

Because it conflicts with another appeals court ruling that upheld the law, the Supreme Court is expected to take it up during its term that begins in October with a ruling possible just months before the November 2012 presidential election.

Legal experts said it was impossible to predict how the high court will rule but agreed that it may be a close vote by nine ideologically divided justices, with moderate conservative Justice Anthony Kennedy as the possible swing vote.

Justice Kagan, as Solicitor General, was one of the Architects of ObamaCare so may have to recuse herself leaving a 4-4 split with Kennedy going to be the decider.

SO you wonder what kind of Chicago tactic they will use. After all, this is the ultimate wet dream for 90 years by Liberals. It’s their baby. They’ll do ANYTHING to protect it. ANYTHING!

And they will be in the midst of a full on Nuclear Annihilation of whomever the Republican nominee is because they surely can’t run on their record so it’s all-out attack mode to infinity and beyond.

Further, the Obama administration on Friday issued new incentives for states and people to participate in health insurance exchanges, including tax credits and funding grants for the states.

One of the three judges, Stanley Marcus, dissented from the majority opinion in his own 84-page opinion.

The majority “has ignored the undeniable fact that Congress’ commerce power has grown exponentially over the past two centuries and is now generally accepted as having afforded Congress the authority to create rules regulating large areas of our national economy,” wrote Marcus, also a Clinton appointee to the appeals court.

In short, to this liberal it’s undeniable that the government has to sole power to run your life for you. (Obamacare, FTC,FCC,EPA,FDA et al).

“The individual responsibility provision — the main part of the law at issue in these cases — is constitutional,” <White House Spokesperson Stephanie> Cutter continued. “Those who claim this provision exceeds Congress’ power to regulate interstate commerce are incorrect.

Notice the Orwellian turn of phrase. The Individual MANDATE is now the Individual RESPONSIBILITY provision.

It is your individual responsibility and your duty to your fellow citizens to submit to the power of Mama Government your life and your freedom. It is your responsibility to submit.

I bet MANDATE will be a “terrorist” word in the not distant future. 🙂

FOOD POLICE UPDATE

The federal government has a growing interest in the eating habits of Americans for the same reason it has an interest in tobacco consumption, said Kathleen Sebelius, the secretary of the Department of Health and Human Services.

The reason is money, because three-quarters of medical-spending is driven by chronic diseases, such as obesity and tobacco-related diseases, she said.

Sebelius’ comments came at the tail-end of Tuesday’s White House press conference where officials showcased nine new photos that must be carried on cigarette packs. Officials used a survey of 18,000 people to find the images that would have the most distressing impact on groups of smokers, including young smokers and mothers of young kids.

“We want teenagers to understand smoking is gross, not cool,” said the HHS chief. If the public becomes desensitized to the distressing pictures, they’ll be replaced by new pictures, she said.

The regulations are justified, she said, because tobacco causes 443,000 premature deaths, and creates “$200 billion a year in health costs that we clearly could spend better elsewhere,” she said.

But the press questions shifted to food labels when a reporter pressed officials about new food-labeling standards being promoted by the government.

The standards are part of a much larger push by medical professionals to regulate the food sector. The medical professionals, led by the Atlanta-based Centers for Disease Control and Prevention, have allied with professional advocacy groups, such as Center for Science in the Public Interest, and with leading Democratic politicians, to blame the food-sector for increasing obesity rates in the American population, and especially among African-Americans.

People like to eat the increasing amount of cheap food produced by the food industry, and the rate of obesity has climbed steadily. In turn, obesity has spiked government and private health-care costs, because fat people are more prone to expensive diseases such as heart-failure and diabetes.

Federal health-care bills have risen in step, partly because of obesity’s costs, but also because many medical-professionals and Democrats want the federal government to fund a growing portion of the nation’s health-care spending.

These political interests reinforce each other. Health-care professionals say their expertise can reduce the federal government’s health-care costs, and politicians say they need professional expertise to curb the growing cost of expanding federal health-care programs.

First Lady Michelle Obama, for example, has accelerated the process by simultaneously supporting the Obamacare expansion of government spending, while also establishing her ‘Let’s Move’ anti-obesity campaign. The professional campaign is aimed chiefly at African-Americans, and urges parents and children to exercise more and to eat carefully.

In April, the FDA published a new set of rules requiring restaurants to show the calories in each menu item, and the Federal Trade Commission released a set of guidelines for food that is marketed to children. These steps were mandated by the 2009 Obamacare health-sector law.

When asked if the government would extend tobacco-style regulations to food deemed fattening, Sebelius told the reporters that the federal guidelines are only voluntary.

In the same press conference, Margaret Hamburg, the FDA’s chief, added that “we need to work with industry to provide consumers … with the best possible information about nutrition and health so that we can all make good choices in terms of promoting and protecting health.”

“The food industry recognizes there are ways they can improve,” said Hamburg. “We certainly have a vested interest in that as a public health agency, and we want to work with them on that.”

“When the combined voice of the four most important regulatory agencies for [your industry] speak, it is hard for companies to ignore those guidelines, even if you feel they are unwarranted or unfounded,” said McBride. “Industry shares Ms. Obama’s goal of solving childhood obesity within a generation, and we will continue to work with government stakeholders towards that goal,” he said.

SECRETARY SEBELIUS: Well, again, I think tobacco is unique. It is a product that is the number one cause of preventable death. We know that there are strategies that can be very effective, because they’ve been in place. We also know that we’ve been stalled in this country. So I think this effort about tobacco regulation, efforts around tobacco cessation, has been decades-old and is something that is a unique situation.

Having said that, I do think that there are going to be ongoing discussions — as you look at the underlying health care costs, where we spend 75 cents of every health care dollar treating chronic disease — what are the areas, if you want to lower health costs and have a healthier country, that you can focus on? Certainly, tobacco and obesity become two of the major underlying causes. So the work around obesity and healthier, more nutritious eating, more exercise will continue to be I think an ongoing focus.

I think this is some space that is going to continue to have a robust conversation, because, again, it has a lot to do with underlying health costs and overall health of our nation. (Aka ObamaCare) 🙂

But as she stepped off the podium, Sebelius finally threw an answer back to the reporter who had asked if distressing images would be mandated for fattening foods. “Just lots of celery stalks and broccoli,” she said. (Townhall.com)

Tony the Tiger, some NASCAR drivers and cookie-selling Girl Scouts will be out of a job unless grocery manufacturers agree to reinvent a vast array of their products to satisfy the Obama administration’s food police.

Either retool the recipes to contain certain levels of sugar, sodium and fats, or no more advertising and marketing to tots and teenagers, say several federal regulatory agencies.

The same goes for restaurants.

It’s not just the usual suspected foods that are being targeted, such a thin mint cookies sold by scouts or M&Ms and Snickers, which sponsor cars in the Sprint Cup, but pretty much everything on a restaurant menu.

Although the intent of the guidelines is to combat childhood obesity, foods that are low in calories, fat, and some considered healthy foods, are also targets, including hot breakfast cereals such as oatmeal, pretzels, popcorn, nuts, yogurt, wheat bread, bagels, diet drinks, fruit juice, tea, bottled water, milk and sherbet.

Food industries are in an uproar over the proposal written by the Federal Trade Commission, Centers for Disease Control and Prevention, Food and Drug Administration and the U.S. Department of Agriculture.

“The most disturbing aspect of this interagency working group is, after it imposes multibillions of dollars in restrictions on the food industry, there is no evidence of any impact on the scourge of childhood obesity,” said Dan Jaffe, executive vice president of the Association of National Advertisers.

The “Interagency Working Group on Food Marketed to Children, Preliminary Proposed Nutrition Principles to Guide Industry Self-Regulation Efforts” says it is voluntary, but industry officials say the intent is clear:  Do it, or else.

“When regulators strongly suggest a course of action, it’s treated as a rule, not a suggestion,” said Scott Faber, vice president of federal affairs for the Grocery Manufacturers Association.  “Industry tends to heed these suggestions from our regulators, and this administration has made it clear they are willing to regulate if we don’t implement their proposal.”

It’s not just the food industry that will be impacted.  Hundreds of television shows that depend on the advertising revenue, such as the Nickelodeon Channel, ESPN, and programs including “American Idol” will be affected, critics of the proposal say—at a cost of $5.8 trillion in marketing expenditures that support up to 20 million American jobs.

If the food is not reformulated, no more ads or promotions on TV, radio, in print, on websites, as well as other digital advertising such as e-mail and text messaging, packaging, and point-of-purchase displays and other in-store marketing tools; product placement in movies, videos, video games, contests, sweepstakes, character licensing and toy branding; sponsorship of events including sport teams and individual athletes; and, philanthropic activity tied to branding opportunities.

That includes softball teams that are sponsored by food companies and school reading programs sponsored by restaurants.

“The Interagency working group recommends that the food industry, through voluntary self-regulatory efforts, make significant improvements in the nutritional quality of foods marketed to children and adolescents ages 2 to 17 years,” the proposal says.

“By the year 2016, all food products within the categories most heavily marketed directly to children should meet two basic nutrition principles.  Such foods should be formulated to … make a meaningful contribution to a healthful diet and minimize the content of nutrients that could have a negative impact on health and weight.”

The foods most heavily marketed directly to children and adolescents fall into 10 categories: “breakfast cereals, snack foods, candy, dairy products, baked goods, carbonated beverages, fruit juice and non-carbonated beverages, prepared foods and meals, frozen and chilled desserts, and restaurant foods.”

Beth Johnson, a dietician for Food Directions in Maryland, said many of the foods targeted in this proposal are the same foods approved by the federal government for the WIC nutrition program for women, infants and children.

“This doesn’t make any sense whatsoever,” Johnson said.  “It’s not going to do anything to help with obesity.  These are decisions I want to make for my kids.  These should not be government decisions.” (Human Events)

President Obama insisted America was ‘digging itself out of hole’ today as new figures offered a glimmer of hope for the country’s beleaguered economy.

103,000 new jobs were created last month and the unemployment rate dropped to 9.4 percent, its lowest level in 19 months, the Labor Department said. (Daily Mail)

However, to get a true understanding of the data we must go further into the story.  For example, the economy needs to create 125,000 new jobs per month simply to keep up with the population demands for work.  You will notice that even during December, one of the highest months for hiring due to temporary retail needs, only 110,000 jobs were created, and thus there was a deficit of 15,000 jobs last month simply to stay even with the population. (Globe & Mail)

Secondly, the Labor Department does not record those unemployed who are not out actively looking for work.  Once someone falls off the unemployment benefit roles, there is no requirement to apply for jobs to ensure benefits.  When these people fall off, they are no longer counted in the unemployment data.

Still, the unemployment rate has topped 9 percent for 20 months, the longest such streak on record. And even with last year’s job gains, the unemployment rate fell only from 9.7 percent to 9.4 percent. (Daily Mail)

That would not be the “saved or created” jobs in Unions and government jobs, by the way…

So we had less employment than we need, we had by estimates something like 260,000 people stop looking (so they aren’t counted) and this was the good news!

But don’t worry, this is all Bush’s Fault too!.

And when Ben Bernacke estimates that it could be 5 years before employment levels are “normal” that too is Bush’s Fault! (and if unemployment over 8% becomes “normal” that too will be Bush’s fault).

This is the slowest recovery, if you can call it a recovery, since the 1930s. Businesses beset by the highest corporate tax burden in the world and the looming presence of ObamaCare and cap-and-trade regulation are simply marking time in an uncertain future.

Of the more than 14.5 million people out of work in December, more than 6.4 million have been out six months or longer. The mean length of time the unemployed have been out of work rose a third straight month to 34.2 weeks, the third highest level ever.

Add in those who’ve stopped looking for work or who are working part-time but want to work full-time, and the number of unemployed climbs to 26.1 million — for a jobless rate of 16.7%. (IBD)

But that too is Bush’s Fault!

If by a miracle Obama is re-elected that won’t be Bush’s fault, but the economic ruin left by ObamaCare (if it survives that long) as it kicks into high gear will be. Just wait and watch.

Obama, if re-elected will leave office in 2016, just at the point where ObamaCare really hits the gas with spending.

But that will still be Bush’s Fault if it survives The Supreme Court or the House Republicans.

POLITICAL CORRECTNESS UPDATE

The words “mother” and “father” will be removed from U.S. passport applications and replaced with gender neutral terminology, the State Department says.

“The words in the old form were ‘mother’ and ‘father,’” said Brenda Sprague, deputy assistant Secretary of State for Passport Services. “They are now ‘parent one’ and ‘parent two.’”

A statement on the State Department website noted: “These improvements are being made to provide a gender neutral description of a child’s parents and in recognition of different types of families.” The statement didn’t note if it was for child applications only. (FOX)

So my mother who passed away on Sept 29th was she #1 or #2??

Gay rights groups are applauding the decision.

“Changing the term mother and father to the more global term of parent allows many different types of families to be able to go and apply for a passport for their child without feeling like the government doesn’t recognize their family,” said Jennifer Chrisler, executive director of Family Equality Council.

Her organization lobbied the government for several years to remove the words from passport applications. (FOX)

Happy New Year, New Congress: Be Prepared to be Electrocuted or Go Home

What I don’t want to see in the new Congress: Partisan Mudfights.

As fun as it may be to just all Terminator on the Obama administration with investigations all that does is sink to the Democrats level of partisanship, aka investigate Bush for everything and anything no matter how outlandish or insane not caring about anything other than “Gotcha!” politics.

We don’t need that now. We need Leadership. Not a Partisan driven Gotcha.

Spending. Congress has, by constitutional right, the power of the purse strings. The new Congress must use this power to slash spending to the pre-meltdown, pre-stimulus levels of 2007. Federal spending today is over 25% of GDP — nearly a quarter above its historic average. The Democrat-led 111th Congress added $3.2 trillion to the national debt, the most in history.

With an estimated $10 trillion in debt expected over the next decade from current programs, and a wave of spending coming to take care of the tidal wave of baby boomers who’ll be retiring at the rate of 10,000 a day the next couple of decades, government better stop spending now — or go bankrupt.

Period. End of Story!

Within 5 years, just 5 years, the INTEREST on the National Credit Card will be more than we spend on the Military, it will be so massive that it will be the single largest expenditure we have as a nation.

That is unsustainable. It must stop. Period!

Today the top-earning 5% of taxpayers — having incomes over $159,619 (well below “the Rich” of 250,000 )— earn 35% of the nation’s income, but pay 60% of individual income taxes. This is unfair and inefficient, with estimates of as much as a $150 billion reduction in GDP each year.

“The Rich” the liberals are so obsessed with pay nearly 1/2 of all taxes but have the highest taxes. And you want to screw them even more and expect to them to love you and kiss you and roll over and play dead marxist??

I don’t think so. Grow up!

Life isn’t fair.

And the debt wracked by the government and the people is real and only the government and the people can stop it.

Now!

ObamaCare. Because you don’t have the Senate and the President you won’t be able to repeal it. You must slow it down though and get rid of some of the most onerous things if you can.

Personally I think the liberals will fight to your death for this Golden Goose Egg of Socialism.

So we have to cut spending.

Prepare to be electrocuted or go home.

The Republican House and the 47 GOP senators should nonetheless reintroduce the topic into the debate, even pass a bill in the House. They should also promote market improvements of Medicare. The public needs to understand why this is necessary — and why the Democrats’ inevitable resistance puts our nation at risk.

The GOP must be careful, though, of accepting a “bipartisan compromise” that perpetuates the worst features of the current system. With a $107 trillion deficit expected over the long term, the two entitlement programs must be overhauled. There’s no choice.

It’s the 20,000 lib Gorrila on steroids that is guarded by an Imperial Starfleet of Unions, Democrats and the Not-In-My-Backpocket Scare tactics that must be taken down or else it’s over, it’s all over.

Too bad if you don’t like it. Too bad if you don’t want to.

The truth is the truth, deal with it. You don’t have to like it, you’d don’t have to approve.

It’s very bad medicine that you have to swallow or else.

No option.

Except complete and utter failure of everything.

No pressure.

Congress needs to refocus the Fed on what it does best: keep inflation under control and help oversee the commercial banks. Most important, any reforms must keep the central bank’s political independence — which studies show is what makes a central bank most effective.

Pumping money we don’t have into a broken economy is not making it better.

Keynesian Economics DOES NOT WORK! Period. End of story.

Fannie Mae and Freddie Mac. One of the great disgraces of the 111th Congress was the passage of a financial overhaul bill that left the two main causes of our financial meltdown untouched. At one point, Fannie and Freddie controlled half the $13 trillion U.S. mortgage market.

For years, Congress and presidents alike have used the two to subsidize cheap home loans to undeserving borrowers to garner votes and boost the U.S. homeownership rate. The two have already cost U.S. taxpayers $135 billion, but may end up costing as much as $700 billion, estimates show. Republicans can rectify this by holding new hearings, then privatizing them or shutting them down.

Fannie & Freddie must die so that we may live. Period.

TSA reform. The Transportation Security Agency is out of control. As agents make X-rated X-rays of passengers and grope their private parts, screeners continue to let guns, knives, explosives and bomb parts sift through the security line.

Meanwhile, Israel’s El Al, considered the world’s most secure airline, has a different strategy. Wisely disregarding political correctness, it uses ethnic profiling and asks passengers inconvenient questions. How about changing strategy here and considering the Israeli model? Our lawmakers need to have the courage to take the lead on making our skies safer and air travel less stressful.

Yes, folks, RACIAL PROFILING!

Net neutrality. The Federal Communications Commission, saying it wants to establish a free and open Internet, has voted to impose regulations on the Web. But far from freeing the Web and making it more wide open, net neutrality rules give Washington the power to determine how Internet service providers handle the traffic that flows over their infrastructure.

The Liberals need to have government run everything in your life from birth to death (and beyond with the Death Taxes) has got to be stopped.

Full funding for the border fence is a must to ensure that U.S. agents, not Mexican cartels, control the border. Congress must end the current White House policy of cherry-picking criminal cases, but ignoring others.

Also, legal immigration to the U.S. must be made speedier and less costly. Legal immigrants wait in long lines and pay an average $6,000 to enter legally. One idea: an express lane for those with education and training who can fit into our economy right away.

SECURE THE BORDER. Then we’ll talk. The End.

According to the Small Business Administration, red tape costs the economy $1.75 trillion each year — more than the GDP of Canada and equal to all corporate profits. It also adds up to $15,000 per household.

And with the 2nd highest Corporate Tax in the world, and the economic turmoil CREATED by liberals we aren’t attractive to even businesses in THIS country let alone another.

This has to stop.

The Liberals need to grow up.

That’s nearly nearly impossible, so we have to go around them and prove it can work.

The time For Childishness and liberal dreams of social and economic “equality” for all are over.

Period.

Federal regulations go on for 70,000 pages. Under Obama, regulatory bureaucrats are drawing more power. The EPA, FCC and FDA, to name just a few, are issuing sweeping new rules for us to live under. Enough.

ENOUGH IS ENOUGH!

The drug binges have to stop now or the patient dies.

Period.

No option.

No Choice.

Just do it!

OR ELSE!

Period.

No one should care if you don’t like it. It’s the cold hard reality.

The Real Star Wars

This is a tale of a young Senator who set out to change the world. To grab power. To reshape everything.

To fundamentally violate one of the truth of existence and to fight against it.

That truth, LIFE ISN’T FAIR.

I believe (to borrow another movie) it to be the Inception idea that started modern Liberalism.

If Life isn’t fair, then let’s make it equal. So that it is no more or less fair for anyone.

But that way leads to The Dark Side.

The Sith await you.

Think about it, you have a (in this case young) Senator who rises in a time of stress and War and Crisis. He promises hope & change. Though the hope and change he wants is to control everyone and everything. That way, Social Justice is “Fair”. And Life if “fair”.

In the time of crisis he is granted powers and takes steps no leader has ever dared take before. He takes over the Banks, insurance companies, the auto industry.

He consolidates more power to central authority that ever before. he is playing both sides against each other in the name of “fairness” to consolidate power. Because, after all, they only way life can be “fair” is if you control it from birth to death.

You have no freedom. But it’s Fair! 😦

But life is not fair.

And this frustrates him. He has such a grand vision. But he can’t get it done.

It’s not fair!

He’s so much smarter than everyone else. He’s so much better. More enlightened.

And all he wants is for everyone to be equal. Now that’s “fair”.

And before the November 2nd elections (9/10/10): “If it was just a referendum on whether we’ve made the kind of progress that we need to, then people around the country would say ‘We’re not there yet,'” Obama said.

“If the election is about the policies that are going to move us forward, versus the policies that will get us back into a mess, then I think Democrats will do very well.”

And on Nov 2, he and his minions were “shellacked”. But that didn’t stop them from have a very productive Lame Duck Session where they got 90% of what they wanted.

As a matter of fact, he’s now the “Comeback Kid”. The Emperor has New Clothes.

But still he fears that his life’s work will be undone, challenged or left unfulfilled. The dreams of 90 years of Progressive Liberalism rest upon his shoulders.

His vision.

So, like Palpatine, he will have to be craftier and take more control rather than letting his minions like Darth Vader do all the heavy lifting.

And who hates more liberals.

Only Radical Muslims and terrorists.

Class Warfare. Hate the rich (but not the Liberal Rich like George Soros or even Obama who made $5 million dollars last year).

Race Warfare. Pitting blacks and Hispanics against Whites because Whites are “not fair” and oppressive.

Despite the fact that liberal policies hurt blacks and hispanics.

It keeps them down.

The promise of “fairness” and “Justice” keep them in line. Even though in the 50 years they haven’t even come close to either.

Religious Warfare. The more Progressive (aka radical) they are the seemingly more anti-religious they are- especially Christianity.

How is that different from the Sith wanting to wipe out the Jedi??

The Jedi are spiritual. The Force is spiritual.

They must be crushed.

The State is your only salvation.

The Government is your protector. Your savior.

Not yourself.

But if Obama is Senator Palpatine, cum Emperor-wanna be, who is Darth Vader. The angry, power mad servant of the Dark Side?

Nancy Pelosi, who else. 🙂  (Not Dick Cheney as the Liberals tried to use in 2005 after Bush beat Kerry for re-election)

But it does point to the fact that when Liberals object to the dirty tricks way things are being done “unfairly” that usually means they have already done them and you’re not allowed to do what they are doing because they are so vastly superior and more “fair” than you.

But Darth Vader never got demoted to a Minority Position. This should just strengthen her backbone and her insanity.

She will hate even more at being thwarted and simultaneous be proud of her many accomplishments over the last 2 years.

Obstructing the rebel scum will be new mission. They cannot be allowed to retake what she has taken.

After all, it is my own opinion that Nancy Pelosi thought she was the Empress for the last 2 years and that Barack was the upstart who was getting in HER way.

Then there’s The Conspirator, aka Harry Reid. He who works behind the scenes to make it work through any means necessary.

You have the faceless “enemy”- The Rich. The Corporations. The Separatists.

You have the faceless, uniform soldiers of the cause, The Unions and the Bureaucracy. A hegemony of purpose and the foot soldiers of the cause.

And then you ad in an Orwellian touch, The Ministry of Truth. The Liberally-biased media that is a champion of the Empire’s needs and wants and will spread it’s message and lies far and wide across the land. Willingly so. And they all proclaims to be “fair” and “objective”.

Those who disagree with this view are the evil ones who are not fair and not objective: FOX,the Internet-Like Drudge,Daily Caller etc, and Talk Radio.

Which is why they must be controlled. So you send out the faceless bureaucratic clone minions of the FCC, the FTC, the FDA to stop them.

The SEIU are the people’s clone army. Foot soldiers for the cause.

Then there are the Liberal lawyers and judges who stop the resistance by ruling from ideology under the cover of law. To control the people ever further.

Then comes the Resistance, The Rebel Alliance.

A loose band of like-minded independent people who just want their freedoms back. To restore democracy and give all people a chance.

Meet THE TEA PARTY.

Hated, denigrated, and reviled by the Imperials.

But their allies in the Government haven’t proven they can be trusted yet. Not after the Lame Duck give aways they allowed.

So this chapter in the saga has yet to be written and it falls to all of us in the movement to keep the pressure on.

To quote yet another movie, “Never Give up! Never Surrender!”

Or as Master Yoda might say, ““Do or do not… there is no try.”
