A Georgia high school student slated to receive a full athletic scholarship to college will not graduate on time after being suspended for one year last week as punishment for hugging a teacher in Nov.

17-year-old Sam McNair of Duluth High School was found guilty of violating the school’s rules regarding sexual harassment for a hug that was captured on video by a surveillance camera.

The teacher alleges McNair’s lips and cheeks touched the back of her neck, but the student has adamantly denied such allegations.

“I did not,” McNair told KCTV.

“Something so innocent can be perceived as something totally opposite,” he added.

Well, when you create an atmosphere for the teacher that if they just look at the kid the wrong way they’ll be sued for all kinds of things (I was warned about this 20 years ago when I was in The College of Education at Arizona State).

Don’t be alone with a kid EVER, because then you could be sued or fired or both for sexual harrassment. Etc.

So now they’ve extended then paranoia to students.

Geez, aren’t “zero tolerance” bureaucrats, liberals, and lawyers just the best Christmas Gift you get this fine Holiday Season (shhh..Don’t say “Christmas” it’s politically incorrect and discriminatory!).

According to the discipline report, the teacher had previously warned McNair hugs were inappropriate, KCTV reported. However, the 17-year-old disputes such claims and his mother doesn’t understand why she was never informed her son’s hugging was problematic.

“He’s a senior. He plays football and was getting ready for lacrosse and you’re stripping him of even getting a full scholarship for athletics for college,” April McNair told KCTV.

Well, he’s obviously a rampant sexual predator and he had to be disciplined.

And he doesn’t have Affluenza (see yesterday’s blog) so he must be stopped!

Hugs are just a gateway drug bigger and and more offensive sexual crimes, after all!!

Sharese Shields Ages, an education attorney not associated with the case, said school districts have a responsibility to crack down on sexual harassment but also thoroughly educate students about what constitutes sexual harassment. 

“The school district should do a very good job communicating to both parents and students what appropriate contact is between students and teachers and to the extent that they have not done that it was an extreme punishment for the student,” said Shields Ages.

Sloan Roach, a spokesperson for Gwinnett County Public Schools, would not comment on McNair’s case but said in a statement that “hearing officers consider witness testimony, a review of the known facts, and a student’s past disciplinary history…when determining consequences.”

Could you get a more coldly bureaucratic response?

Sam McNair does have a discipline record and previous suspensions but not for sexual harassment and he does not believe he should be punished for showing affection. 

“You know what someone’s going through. A hug might help,” said Sam McNair.(Channel 5 Atlanta)

A 6-year-old boy has been suspended from a Colorado school for kissing a girl on the cheek.

School officials in Canon City are accusing Hunter Yelton of sexual harassment and they want it on his school record.

A 6 Year old Sexual Predator! Imagine that…

A School District RE-1 official says the repeat offenses meet the school policy definition of sexual harassment and they hope the tough standards will force the boy to change his behavior.

Imagine was a sexual fiend this kid will be when he’s 18. He’ll be killing Prostitutes and spreading disease  left and right so we have to stop this serial killer before it starts! 🙂

The school district, for its part, disagrees with Yelton’s mother’s opinion about the boy’s behavior and says kissing a girl at school is unacceptable, the station reported. 

Sandy Wurtele, a child psychologist, was critical about the district’s decision to punish the boy over the kiss.

“I don’t think a 6-year-old would understand what harassment is,” Wurtele told KRDO. “That has some longer-term implications.”

And these are the same kind of bureaucrats you want for Health Care?? 🙂

Charity Begins with Washington :) IN Triplicate

No good deed will go unpunished under ObamaCare. If a charitable hospital treats a homeless person who staggers into the emergency room without insurance, it may be punished with taxes and fines.

One of the “unintended” consequences of the misnamed Affordable Care Act was to place charitable tax-exempt hospitals in a medical Catch-22: To maintain their tax-exempt status they’re required to treat a minimum number of patients who can’t pay, yet ObamaCare requires everyone to have health coverage.

Right now, about 60% of the 6,000 or so hospitals in the U.S. are tax-exempt nonprofits, while 25% are government-owned. The rest — fewer than 1,000 — are for-profit. But this may change under provisions of ObamaCare to be enforced by the IRS.

A provision in Section 501 of the Internal Revenue Code that takes effect under ObamaCare sets new standards of review and installs potential financial penalties if hospitals don’t conform to IRS standards of when and how much charitable work can be performed.

Religious groups, especially Catholic orders, opened many of these facilities as charitable institutions. The IRS originally granted tax-exempt status to institutions that provided a “community benefit,” defined as spending 3% of operating revenue to take care of patients who couldn’t pay.

This benefited the hospitals as well as the community, for if you counted all the sales, property and income taxes that nonprofit hospitals currently avoid paying, it would total $20 billion.

The quality of mercy may not be strained, but it must now be carefully defined and audited with stringent new reporting requirements. “It (the IRS) requires tax-exempt hospitals to do a community needs survey and file additional paperwork with the IRS every three years,” says John Kartch of Americans for Tax Reform. “This is to prove that the charitable hospital is still needed in their geographical area — ‘needed’ as defined by ObamaCare and overseen by IRS bureaucrats.”

“Failure to comply, or to prove this continuing need, could result in the loss of the hospital’s tax-exempt status,” Kartch adds. “The hospital would then become a for-profit venture, paying income tax.”

Failure to complete a community health needs assessment in any applicable three-year period results in a penalty on the organization of up to $50,000, according to a report by Congress’ Joint Committee on Taxation.

It is our belief that community need is best determined by those who reside in the community, not by faceless Washington bureaucrats with a vested interest in growing government and imposing leftist ideology.

We also believe the record shows faith-based and charitable institutions are most efficient at delivering needed services to the poor, hungry and sick. They should be encouraged, not punished, for their work.

Yet the government is rigging the game against them, in this case against nonprofit charitable hospitals. All blessings must flow from that government, which will determine who can help the needy and when, lest they be punished, either with loss of tax-exempt status or fines for not having the proper paperwork.

Faith-based institutions such as Catholic hospitals are already under attack because of ObamaCare’s mandate that free contraceptives be provided in any health plan even if that violates your free exercise of religion under the First Amendment.

One in six patients in the U.S. is in a Catholic hospital. Catholic charities provide needed services to the hungry, homeless and poor. Many would be forced to close, and many would do so rather than render unto Caesar that which is not his. ObamaCare may spell the doom of nonprofit hospitals.

So, if you’re that Good Samaritan who sees someone in need along the road, make sure the government approves and have your forms in order. (IBD)

Consider: Hit by years of budget cuts, some U.S. public school boards are looking to avoid providing health benefits to substitute teachers and supporting staff under President Barack Obama’s reform law, education officials say.

According to the law, employers will have to offer health coverage to all full-time employees, defined as those who work an average of 30 or more hours per week each month, or else pay a fine starting in 2015.

School boards, already struggling to manage after years of state budget cuts, are trying to get ahead of the potential costs of Obamacare for the current academic year, education and labor officials say. The need to find creative solutions, or risk cutting back staff hours further, will increase as they finalize their budgets, they say.

In Pennsylvania’s Penn Manor School District, Superintendent Mike Leichliter said there is no room in its constrained budget to provide additional employee insurance. Instead of cutting hours, the district used a substitute-teacher contracting service to pay part of the salaries for 95 employees. Money for such a service does not count against the school’s budget.

“When we looked at our costs, (healthcare) was one area that really had the potential to skyrocket,” Leichliter said. “This is absolutely the worst time for school districts to be faced with mandated increases.”

“It creates a lot of inconsistency in staffing, and I can’t see how that would be good for students,” Wehrbein said. “How could you have a teacher teaching English four days a week and then on the fifth day you have someone else?” (townhall)

MSDNC’s Melissa “I’m Bat shit crazy” Harris-Perry on Detroit bankruptcy: In the case of Detroit, the reason that the tax base has become so small is because a loss of population, right? So folks out, they are not there to pay the taxes on the homes and the kind of deterioration is what you see in the numbers you’ve suggested. But this lack of tax base is also exactly the kind of thing that many Republicans would impose on us, even when our cities have sufficient populations, even when our communities have sufficient populations. This is what it looks like when government is small enough to drown in your bathtub, and it is not a pretty picture.

Okay… so, let’s go ahead and get this straight. Detroit has been a bastion of All Thing Progressive for decades, with the government and its pension funds and etcetera spending themselves into oblivion while residents have been fleeing the accompanying signs of economic and social depreciation — which effectively worsened the problem of too much government spending by shrinking the available tax base and cutting into revenue — all of which has finally led to the inevitable conclusion of Detroit’s fiscal ruin.

Despite this entirely liberal achievement, Harris-Perry tries to use the example of Detroit to criticize Republicans for… wanting to lower taxes? (Blaze)

Which, for Democrats, works for them. That’s what they like. They can control you, you are their slave if you can’t or won’t fish and they give it to you.

BIG BROTHER OBAMACARE UPDATE

Would you trust thousands of low-level Federal bureaucrats and contractors with one-touch access to your private financial and medical information? Under Obamacare you won’t have any choice.

As the Obamacare train-wreck begins to gather steam, there is increasing concern in Congress over something called the Federal Data Services Hub. The Data Hub is a comprehensive database of personal information being established by the Department of Health and Human Services (HHS) to implement the federally facilitated health insurance exchanges. The purpose of the Data Hub, according to a June 2013 Government Accountability Office (GAO) report, is to provide “electronic, near real-time access to federal data” and “access to state and third party data sources needed to verify consumer-eligibility information.” In these days of secret domestic surveillance by the intelligence community, rogue IRS officials and state tax agencies using private information for political purposes, and police electronically logging every license plate that passes by, the idea of the centralized Data Hub is making lawmakers and citizens nervous.

They want INFORMATION. 🙂

They certainly should be; the potential for abuse is enormous. The massive, centralized database will include comprehensive personal information such as income and financial data, family size, citizenship and immigration status, incarceration status, social security numbers, and private health information. It will compile dossiers based on information obtained from the IRS, the Department of Homeland Security, the Department of Defense, the Veterans Administration, the Office of Personnel Management, the Social Security Administration, state Medicaid databases, and for some reason the Peace Corps. The Data Hub will provide web-based, one-stop shopping for prying into people’s personal affairs.

BIG BROTHER KNOWS EVERYTHING ABOUT YOU….

Not to fear, HHS says, the Data Hub will be completely secure. Really? Secure like all the information that has been made public in the Wikileaks era? These days no government agency can realistically claim that private information will be kept private, especially when it is being made so accessible. Putting everyone’s personal information in once place only simplifies the challenge for those looking to hack into the system.

However, the hacker threat is the least of the Data Hub worries. The hub will be used on a daily basis by so-called Navigators, which according to the GAO are “community and consumer-focused nonprofit groups, to which exchanges award grants to provide fair and impartial public education” and “refer consumers as appropriate for further assistance.” Thousands of such people will have unfettered access to the Data Hub, but there are only sketchy guidelines on how they will be hired, trained and monitored. Given the slap-dash, incoherent way Obamacare is being implemented the prospect for quality control is low. And the Obama administration’s track record of sweetheart deals, no-bid, sole-source contracting and other means of rewarding people with insider access means the Data Hub will be firmly in the hands of trusted White House loyalists.

So if you think the IRS targeting Tea Party groups was bad, just wait for the Obamacare Navigators to be unleashed. “Trust us,” the administration says, no one will abuse the Data Hub. Sure, because that has worked out so well in the past. (rare.us)

I suppose the idea of — oh, I don’t know — the government spending less, and not making promises that it can’t afford to keep, and people instead using more private-sector, free-market means and reaping the benefits of the subsequent economic growth, isn’t an option, then?

And people making choice that Home Superior Liberalis don’t like is just not an option.

The same malign alliance between a corrupt political class, rapacious public-sector unions, and an ever more swollen army of welfare dependents has been adopted in the formally Golden State of California, and in large part by the Obama administration, whose priorities — “health” “care” “reform,” “immigration” “reform” — are determined by the same elite/union/dependency axis. As one droll tweeter put it, “If Obama had a city, it would look like Detroit.”…

Like Detroit, America has unfunded liabilities, to the tune of $220 trillion, according to the economist Laurence Kotlikoff. Like Detroit, it’s cosseting the government class and expanding the dependency class, to the point where its bipartisan “immigration reform” actively recruits 50–60 million low-skilled chain migrants. Like Detroit, America’s governing institutions are increasingly the corrupt enforcers of a one-party state — the IRS and Eric Holder’s amusingly misnamed Department of Justice being only the most obvious examples. Like Detroit, America is bifurcating into the class of “community organizers” and the unfortunate denizens of the communities so organized. (Hot Air)

Close Second:  White House Press Secretary Jay Carney appeared on CNN’s “Piers Morgan Live” Thursday night to answer questions related to the three separate scandals that have turned the federal government on its head over the last two weeks.

Carney’s answers summed up: There are no scandals.

“You’re concocting scandals that don’t exist,” Carney said, when show host Piers Morgan asked how the Obama administration would “restore the faith that some Americans have lost” in its transparency.

“Especially with regard to the Benghazi affair that was contrived by Republicans and, I think, has fallen apart largely this week,” Carney said.

He continued, . And we are committed to that. The president is committed to that.” (Blaze)

Today comes the revelation in The Wall Street Journal that “A key department memo discussing Joseph Wilson’s Niger trip was classified ‘Top Secret,’ and the passage about his wife’s CIA role was specially marked ‘S/NF’ — not to be shared with any foreign intelligence agencies.”

Perhaps even more damning are reports that the Top Secret-S/NF document was apparently first delivered to Air Force One when George W. Bush and Colin Powell (who had apparently requested it from analysts within the State Department) were flying to Africa in 2003.

Somehow – nobody knows at the moment – the information in this Top Secret-S/NF document (the identity of Joe Wilson’s wife) then migrated from Air Force One to George W. Bush’s assistant, Karl Rove, and Dick Cheney’s assistant, Scooter Libby. Rove and Libby then immediately began “dialing for dollars” – calling reporters with this juicy bit of Top Secret-N/SF information – in an attempt to politically assassinate Joe Wilson.

Which raises the question: “What did the President know, and when did he know it?”

But they are as as silent as the grave on Obama when you pose that same question now. 🙂 Is there such a thing as Anti-Silence? 🙂

Mr. Obama promised to transcend the old politics and bring a new era of hope-and-change transparency to Washington. Five years later, those vows are in shambles.True, the killing of four Americans in Benghazi, Libya, has become a mess of partisan bickering, but the disturbing facts now transcend politics. The Obama administration — the president himself, Mrs. Clinton as secretary of state, U.N. Ambassador Susan E. Rice, White House press secretary Jay Carney — all at various times blamed an obscure video maker for the “spontaneous violence” that killed Americans last September.The problem is not just that such scapegoating was untrue, but that our officials knew it was untrue when they said it — given both prior CIA talking-point briefings and phone calls from those on the ground during the attacks.

One theme ties all the bizarre aspects of the Benghazi scandal together — the doctored talking points, the inexplicable failure to beef up diplomatic security before the attacks and to send in help during the fighting, the jailing of a petty con artist on the false charge that his amateur video had led to attacks on our consulate, and the shabby treatment of nonpartisan State Department whistleblowers.

There was an overarching pre-election desire last year to downplay any notion that al Qaeda remained a serious danger after the much-ballyhooed killing of Osama bin Laden. Likewise, Libya was not supposed to be a radical Islamic mess after the successful “lead from behind” ouster of Moammar Gadhafi. Facts then had to change to fit a campaign narrative.

As the congressional hearings on Benghazi were taking place last week, we also learned that the Internal Revenue Service, administered by the Department of the Treasury, has been going after conservative groups in a politicized manner that we have not seen since Richard Nixon’s White House. There was no evidence that any of these conservative associations had taken thousands of dollars in improper tax deductions — in the manner of former Treasury Secretary Timothy F. Geithner, the onetime overseer of the IRS.

Instead, groups with suspiciously American names like “Patriot” or “Tea Party” prompted IRS partisans to scrutinize their tax information in a way that they would not have for the tax-exempt MoveOn.org or the Obama-affiliated Organizing for Action. On top of that, the Justice Department just announced that it had secretly seized the records of calls from at least 20 work and private phone lines belonging to editors and reporters at The Associated Press in efforts to stop suspected leaks.

At about the same time as the Benghazi and IRS disclosures, it was widely learned that there was a strange relationship between the Obama White House and the very center of the American media — odd in a way that might explain the unusually favorable media coverage accorded this administration.

Ben Rhodes, the deputy national security adviser for strategic communications in the Obama administration, is linked to the doctoring of the Benghazi talking points. He also happens to be the brother of CBS News President David Rhodes. CBS recently pressured one of its top reporters, Sharyl Attkisson, for “wading dangerously close to advocacy,” as one report worded it, in her critical reporting of Benghazi.

Unfortunately, such relationships are not rare with this administration. The head of ABC News, Ben Sherwood, has a sister who works for the Obama White House as a special assistant, Elizabeth Sherwood-Randall.

There is more. The CNN deputy bureau chief, Virginia Moseley, is married to Mrs. Clinton’s former aide at the State Department, Tom Nides, who is also a former Fannie Mae executive. Mr. Carney, Obama’s press secretary, is the husband of Claire Shipman, the senior national correspondent for ABC’s “Good Morning America.”

Apparently, in the logic of the Obama White House and the Washington media, there is nothing improper about wives dispassionately reporting to the nation on what their husbands are doing, or brothers adjudicating the news coverage of their own siblings.

Last month, the congressional architect of “Obamacare,” Sen. Max Baucus, Montana Democrat, announced his plans to retire — in part because he feared his legislative child would become “a train wreck.” Senate Majority Leader Harry Reid, who shepherded the bill toward passage, has echoed that worry.

Democrats are panicking because before the Patient Protection and Affordable Care Act is even fully implemented in the midterm election year 2014, it appears neither affordable nor protective of patients. That reality was long ago foreseeable — given that Obamacare passed on a strictly partisan vote, with a number of questionable legislative payoffs to skeptical fence-sitting Democrats, and even after House Speaker Nancy Pelosi, who helped ram the bill through the House, admitted that, “We have to pass the bill so that you can find out what is in it.”

Your new #2 at the “Social” Justice Department, James Cole, appointed by recess fiat from Obama’s vacation in Hawaii:  Cole went on to write that the United States has faced “many forms of devastating crime,” from the drug trade to organized crime to rape and child abuse. “The acts of Sept. 11 were horrible, but so are these other things,” he wrote.

Ah, good old liberal Moral Equivalency where nothing is better or worse than anything else. Just different.

And that 3,000 people dying in an actual terrorist attack is the same as a rapist. No more important than that.

The reason why New Yorkers were buried in snow for days on end and 2 people died (including a baby) is because the Sanitation UNION was “quietly” protesting. They were having a childish moment of defiance!

Yes, you got it. They deliberately took their time and did it as slow as possible to protest cuts in their budgets.

Indolent New York City union officials who oversee snow removal apparently live by a different creed: Sloth enhances political power, Da Boss slow the plow.

Come rain or shine, wind, sleet or blizzard, Big Labor leaders always demonstrate perfect power-grabby timing when it comes to shafting taxpayers. Public-sector unions are all-weather vultures ready, willing and able to put special interest politics above the citizenry’s health, wealth and safety. Confirming rumors that have fired up the frozen metropolis, the New York Post reported Thursday that government sanitation and transportation workers were ordered by union supervisors to oversee a deliberate slowdown of its cleanup program — and to boost their overtime paychecks.

Why such vindictiveness? It’s a cold-blooded temper tantrum against the city’s long-overdue efforts to trim layers of union fat and move toward a more efficient, cost-effective privatized workforce.

New York City Councilman Dan Halloran, R-Queens, told the Post that several brave whistleblowers confessed to him that they “were told (by supervisors) to take off routes (and) not do the plowing of some of the major arteries in a timely manner. They were told to make the mayor pay for the layoffs, the reductions in rank for the supervisors, shrinking the rolls of the rank-and-file.”

It would be laugh-out-loud comedy if not for the death of at least one newborn whose parents waited for an ambulance that never came because of snowed-in streets.

For an Obama bureaucrat, however, the will of Congress is a mere speed bump. Hence this regulatory trifecta, each one moving smartly left — and nicely clarifying what the spirit of bipartisan compromise that President Obama heralded in his post-lame-duck Dec. 22 news conference was really about: a shift to the center for public consumption and political appearance only.

These regulatory power plays make political sense. Because Obama needs to appear to reclaim the center, he will stage his more ideological fights in yawn-inducing regulatory hearings rather than in the dramatic spotlight of congressional debate. How better to impose a liberal agenda on a center-right nation than regulatory stealth?

It’s Obama’s only way forward during the next two years. He will never get past the half-Republican 112th what he could not get past the overwhelmingly Democratic 111th. He doesn’t have the votes and he surely doesn’t want the publicity. Hence the quiet resurrection, as it were, of end-of-life counseling.

Obama knows he has only so many years to change the country. In his first two, he achieved much: the first stimulus, Obama-Care and financial regulation. For the next two, however, the Republican House will prevent any repetition of that. Obama’s agenda will therefore have to be advanced by the more subterranean means of rule-by-regulation.

But this must simultaneously be mixed with ostentatious displays of legislative bipartisanship (e.g., the lame-duck tax-cut deal) in order to pull off the (apparent) centrist repositioning required for re-election. This, in turn, would grant Obama four more years when, freed from the need for pretense, he can reassert himself ideologically and complete the social-democratic transformation — begun Jan. 20, 2009; derailed Nov. 2, 2010 — that is the mission of his presidency.– Charles Krauthammer

Ignoring both Congress and the voters, the Environmental Protection Agency starts the new year governing by decree with job-killing regulations. Take a deep breath, but if you exhale you’re a polluter.

Cap-and-trade is dead, long live cap-and-trade in the form of regulations promulgated in the coming year by what George Orwell might call the Ministry of Environment. It claims that the Clean Air Act and a Supreme Court ruling in 2007 let the EPA regulate carbon dioxide as a planet-warming pollutant.

We recently commented on the EPA’s recent commandeering of the permitting process from Texas, with which it is in a legal tussle over federalism, states’ rights and the Constitution’s enumeration of powers and who may exercise them.

The federal agency also plans to issue greenhouse gas permits in seven other states — Arizona, Arkansas, Florida, Idaho, Kansas, Oregon and Wyoming.

The EPA held its fire, hoping a Democratic Congress would get cap-and-trade legislation through both houses. In April, 2009, Time magazine ran a piece titled “EPA’S CO2 Finding: Putting A Gun To Congress’ Head.” Last year the New York Times said that if Congress fails to ram through cap-and-trade legislation, the EPA should ram it down our throats. And so it did.

With Barack Obama’s election, liberal hopes for cap-and-trade rose. But neither businessmen nor homeowners were buying it, especially after the data manipulation and fraud perpetrated by the U.N.’s IPCC, Britain’s Climate Research Unit and even our own NASA.

So now just as rationing and death panels return under regulations written “as the secretary shall determine,” a phrase rapidly replacing “we the people” under this administration, the EPA plans to propose so-called performance standards for oil- and coal-fired power plants in July 2011 and for refineries in December 2022.

“We are following through on our commitment to proceed in a measured and careful way to reduce (greenhouse gas) pollution that threatens the health and welfare or American and contributes to climate change,” says EPA administrator Lisa Jackson. Perhaps she appreciates the irony of the people of Cowlitz, Wash., as columnist George Will points out, approving construction of a coal export terminal to send energy-hungry Beijing coal we won’t burn here. The transporters? Ships that themselves burn fossil fuels.

As it turns out, much of China’s domestic coal is far inland away from urban centers. High-speed trains, as such, have nothing to do with being “green.” Far from it. They enable China to use more coal — not less.

As Sen. James Inhofe, R-Okla., ranking Republican on the Senate Environment and Public Works Committee, related on a YouTube video: “Lisa Jackson, Obama’s EPA administrator, admitted to me publicly that EPA based its action today (issuing its finding) in good measure on the findings of the U.N.’s Intergovernmental Panel on Climate Change, or IPCC. She told me that EPA accepted those findings without any serious, independent analysis to see whether they were true.”

We hope the incoming Republican House will deal rapidly with what is bad regulation based on junk science.

Rep. Darrell Issa, R-Calif., incoming chairman of the House Oversight and Government Reform Committee, says: “There are serious questions about EPA’s decision to move forward with these job-killing regulations that will usurp power from the states, violating the principles of federalism that are the backbone of the Clean Air Act.”

Otherwise China will burn our coal and steal our jobs, polluting planetary skies, with that pollution wafting its way across the Pacific to the Western shores of an industrially neutered America and a foolish California.

Oh, and remember those high-speed electric trains in China that have people like the New York Times’ Tom Friedman cooing over how green China is? James Fallows, writing in the Atlantic, quotes a Chinese official as saying they are being built to move passenger trains out of the way of coal trains. (IBD)

And Obama will want to borrow even more money from them to fund it all!!

On Dec. 23, the Interior Department issued Secretarial Order 3310 reversing a 2003 decision and giving itself the authority to designate public lands as “Wild Lands.” A clever twofer: (1) a bureaucratic power grab — for seven years up through Dec. 22, wilderness designation had been the exclusive province of Congress, and (2) a leftward lurch — more land to be “protected” from such nefarious uses as domestic oil exploration in a country disastrously dependent on foreign sources. That $5 a Gallon Oil price that is coming isn’t from some greedy Texas oil millionaire (or the increase in grocery and other product costs because of it) but a bunch of “green” Liberals who want you in your solar-powered house with your electric car eating government approved food ,watching government approved TV, your end-of-life counseling on the table in front of you, and surfing the Government-approved Internet.

Reach for Hope

“Don’t give in to fear,’’ Obama said yesterday, urging voters to turn back GOP efforts to gain control of the House and Senate in November’s midterm elections. “Let’s reach for hope.’’

Elect me, and I will bring Hope and Change. 18 months later, Reach for that same hope.

Do you suspect that the reach will be like Sisyphus and the rolling the boulder up hill. For his assignment was to roll a great boulder to the top of a hill. Only every time Sisyphus, by the greatest of exertion and toil, attained the summit, the darn thing rolled back down again.

Obama and the Democrats thrive on stress, fear, anxiety and lack of hope. So just in them and all will be wonderful…someday….maybe…but if it’s not it’s Bush’s Fault and you just have to re-double your faith in “hope”. 🙂

They don’t want to actually thrive because you won’t want them to run your life for you then. So it’s better to just “hope”.

WASHINGTON  — Nearly half of the homeowners who enrolled in the Obama administration’s flagship mortgage-relief program have fallen out.

A new report issued today by the Treasury Department said that approximately 630,000 people who had tried to get their monthly mortgage payments lowered through the effort have been cut loose through July. That’s about 48 percent of the 1.3 million homeowners who had enrolled since March 2009. That is up from more than 40 percent through June.

The report suggests foreclosures could rise in the second half of the year and weaken the ailing housing market, analysts say.

Another 421,804, or 32.3 percent of those who started the program, have received permanent loan modifications and are making their payments on time.

Many borrowers have complained that program is a bureaucratic nightmare. They say banks often lose their documents and then claim borrowers did not send back the necessary paperwork.

The banking industry said borrowers weren’t sending back their paperwork. They also have accused the Obama administration of initially pressuring them to sign up borrowers without insisting first on proof of their income. When banks later moved to collect the information, many troubled homeowners were disqualified or dropped out.

(Should sound familiar–Community Reinvestment Act anyone?) 🙂

Obama officials dispute that they pressured banks. They have defended the program, saying lenders are making more significant cuts to borrowers’ monthly payments than before the program was launched. And some of the largest mortgage companies in the program have offered alternative programs to those who fell out.

The Obama plan was designed to help people in financial trouble by lowering their monthly mortgage payments. Homeowners who qualify can receive an interest rate as low as 2 percent for five years and a longer repayment period.

And These are the bureaucrats who are going to save you on Health Care? 🙂

Well, at least that’s what they said during the 15 month fight. As was pointed out yesterday, it’s not what they want to tell you now.

And that Mandate that wasn’t a Tax, is a Tax. They admit it now.

But you’re going to love having government bureaucrats decide how you live and when you die. 🙂

Reach for Hope!

Essentially, we’ve now transitioned from the aforementioned terminology (Saved or created jobs), on to ‘jobs funded’, and eventually landed on something reminiscent of an after school special, ‘lives touched’.

So what exactly defines a touched life?

A spokesperson from the CH2M Hill Plateau Remediation Company explains:

“Lives Touched” is a figure that the U.S. Department of Energy (DOE) uses to track the amount of people who have been positively affected by the Recovery Act funds.  This total would include people who have been provided full time employment (i.e. saved and created jobs) through the Recovery Act and people who at some point have supported a project funded by the Recovery Act.

In other words, the administration has stumbled upon another way to inflate their job numbers.  They were already reporting on those saved or created, but will now include ‘people who at some point have supported a project.’

Lies, Damned Lies, and Stimulus Statistics! 🙂

NEW YORK: In signs of persisting financial woes in the US, the count of bankruptcy filings jumped as much as 20 per cent to 1.57 million in the year ended June 2010, the highest in four years.

The number of businesses going bankrupt climbed eight per cent to 59,608 during the same period, despite signs of economic recovery.

“A total of 1,572,597 bankruptcy cases were filed in federal courts in that period (year ended June 30, 2010), compared to 1,306,315 bankruptcy cases filed in the 12-month period ending June 30, 2009,” according to the latest data available with the Administrative Office of the US Courts.

Moreover, the bankruptcy filings are the highest since 2006 when the number stood at 1.48 million. (Economic Times)

“The President has shown he is willing to work with anyone who will join us to figure out new ways to create more jobs. The Vice-President spends each week making sure we’re squeezing job out of every Recovery Act dollar,”-White House Spokesman on The Summertime Blues list of 100 stimulus ‘projects’ that don’t create anything but debt.

The biggest circumvention of “we the people” was of course the so-called “health care reform” bill. This bill was passed with the proviso that it would not really take effect until after the 2012 presidential elections. Between now and then, the Obama administration can tell us in glowing words how wonderful this bill is, what good things it will do for us, and how it has rescued us from the evil insurance companies, among its many other glories.

But we won’t really know what the actual effects of this bill are until after the next presidential elections– which is to say, after it is too late. Quite simply, we are being played for fools.

Much has been made of the fact that families making less than $250,000 a year will not see their taxes raised. Of course they won’t see it, because what they see could affect how they vote.

But when huge tax increases are put on electric utility companies, the public will see their electricity bills go up. When huge taxes are put on other businesses as well, they will see the prices of the things those businesses sell go up.

If you are not in that “rich” category, you will not see your own taxes go up. But you will be paying someone else’s higher taxes, unless of course you can do without electricity and other products of heavily taxed businesses. If you don’t see this, so much the better for the Obama administration politically.

This country has been changed in a more profound way by corrupting its fundamental values. The Obama administration has begun bribing people with the promise of getting their medical care and other benefits paid for by other people, so long as those other people can be called “the rich.” Incidentally, most of those who are called “the rich” are nowhere close to being rich.

A couple making $125,000 a year each are not rich, even though together they reach that magic $250,000 income level. In most cases, they haven’t been making $125,000 a year all their working lives. Far more often, they have reached this level after decades of working their way up from lower incomes– and now the government steps in to grab the reward they have earned over the years.

There was a time when most Americans would have resented the suggestion that they wanted someone else to pay their bills. But now, envy and resentment have been cultivated to the point where even people who contribute nothing to society feel that they have a right to a “fair share” of what others have produced.

The most dangerous corruption is a corruption of a nation’s soul. That is what this administration is doing. (Thomas Sowell)

IBD: The consequences of government involvement in health care have become more and more apparent as people have become informed about what the health overhaul law would do. No longer does the government seem to be a fairy godmother but rather a tough enforcer of an avalanche of new mandates, taxes and regulatory requirements.

The assurance that government would make sure all Americans have health care coverage has turned into a mandate that we all must have insurance defined by the government and with the government determining what our “choice” of health policies will be.

The latest example of our loss of individual control over health care decisions is playing out deep in the weeds of definitions over what must be counted as medical care and what counts as administrative expense in health insurance — the so-called “medical loss ratio,” or MLR. According to the new law, at least 85% of premium dollars must be spent on medical care for large firms and 80% for smaller ones.

Or put it this way. You spend 75% of your premiums collected on claims. But now the government mandates 85% because that’s “fair”. So where do you get the extra 10%??

Since you aren’t the government and just raise taxes or print more money you have to either cut services or other expenses, or increase the premiums.

And if you increase the premiums the government and the liberals will scream that you’re ‘raping’ the people with greedy capitalism.

Sucks to be you.

It sounds like a simple and straightforward issue, but a world of challenges and complexity lies beneath the surface. The National Association of Insurance Commissioners (NAIC) has been charged with making recommendations to the federal government about what should and should not be counted in the equation.

To show how consequential the decision is, President Obama briefly scheduled, then canceled, a trip to speak to the NAIC meeting in Seattle in mid-August where the MLR issue was being debated.

Many of the decisions being made by regulators could make it almost impossible for private insurance companies to comply, leading inevitably to a government-run health system.

Connecticut state insurance commissioner Thomas Sullivan warned, “What we’ve learned since March, is that if you like your health insurance you may not be able to keep it,” he told the Seattle meeting, “and state regulators will have a role in implementing health care as long as that role supports the goals of HHS (the U.S. Department of Health and Human Services), which may not necessarily be what’s in the best interest of consumers.”

He later told reporters: “I’m concerned there’s still a lot left to be done in interpretation … I fear that some have an agenda to interpret … with the express purpose of getting to a single-payer option.”

Many other health actuaries and experts at the Seattle meeting said they believed the MLR was meant to be so disruptive to private insurance that it would eventually push us into a single-payer system.

HHS is not obligated to take the recommendations of the NAIC. Ultimately, the bureaucracy will decide. And their decision will be hugely consequential.

Let the minutiae wrangling begin! And heaven help you if you’re on the wrong side of a bureaucrat!

An issue that is being most hotly debated right now is whether the federal, state and payroll taxes that insurance companies are required to pay must be counted today as administrative expenses or whether they can be subtracted from premium collections before the calculations are made.

Health insurers say the decision could determine whether they have the money to invest in fighting fraud, setting up networks of qualified physicians and updating information technologies. For other companies, the decision very well could determine whether they survive.

Six senior members of Congress also weighed in on the issue with a letter to the president of the NAIC, saying they meant for taxes to be counted as an administrative expense.

America’s Health Insurance Plans, which represents insurance companies, countered that the legislation specifically says taxes shouldn’t be counted. Other independent analysts have validated the AHIP position.

So the politicization of health care begins, with even the president set to weigh in on a decision that would make most people’s eyes glaze over in the minutia. The president will meet with the NAIC at the White House in September or so to discuss the issue.

It now is clear that decisions about what kind of health insurance we have, how much we must pay, what it covers or doesn’t cover, will be made by politicians and bureaucrats.

This evokes a statement by health economist Paul Starr in his Pulitzer Prize-winning book, “The Social Transformation of American Medicine”: “Political leaders since Bismarck seeking to strengthen the state or to advance their own or their party’s interests have used insurance against the costs of sickness as a means of turning benevolence to power.”

The process has begun. Unless ObamaCare can be rolled back, the politicization of American medicine will reach into the smallest decisions affecting our medical care for decades to come.

And, just five months after the health overhaul law was enacted, we see how the regulatory bureaucracy may well push us into the single-payer, government-run health care system that even the very liberal 111th Congress couldn’t enact. (Even with all the bribes!)

But was predictable given that the Health Care Reform debate was about control, not Health Care.

Just like Immigration enforcement is about Amnesty, not security.

Global Warming is not about the planet.

Financial Reform wasn’t about reform, as much as it was about control.

Remember, Tort Reform was completely ignored during the Health Care debate because Trial Lawyers are too big to ignore Democrats. And Fannie and Freddie were ignored by Financial Reform because the government and the liberals doing the reform were at fault for it’s continued collapse!

It’s about what the politicians want, not what the people want or need.

You are being told you want this, when in fact they want you to want it.

The Drug Addicts want to addict you to their drugs so you’ll demand more of them from them and to do that they will take more of your soul in the process.

Reach for the Hope, Sisyphus!
Trust in them to bring you the Hope all wrapped up in a pretty bow and all nice and shiny.
